Will Your Lease Hold UP?

Just because your Lease covers certain situations or requires the Tenant to pay for certain things does not always mean the Court will enforce those provisions. When can a magistrate’s ruling trump a written contract?
For example,, your tenant wants to move because:
• mice were seen in the apartment
• robberies or domestic disputes were reported in the building
• the tenant gets called to duty for a branch of the armed forces
Or maybe, you want to evict your tenant because:
• the grass got high enough for a code-violation ticket before it gets mowed
• the tenant denies smoking but you smell cigarette odors and your lease prohibits it
• police are frequently called to the premises, or you have other reasons to suspect illegal activity
Or maybe, the tenant failed to pay for all your lawn maintenance services and substantial repairs, as well as your legal fees.
Whether your lease addresses these situations or not, you may not get the eviction or money judgment you want on these and other gray areas. New 3-story building behind Swifton Commons (aka Jordan Crossing) at corner of Reading Road and Seymour Avenue. Langdon Farm Road intersects both Seymour Ave. and Reading Road north of the Norwood Lateral and South of the Ronald Reagan Cross County Highway. From I-75, take the Paddock Road exit and head east on Seymour Ave. about .75 mile. You will need to enter on the plaza level (level 2), which is the level of the outside shopping mall sidewalk.
